c. Whilst we will endeavour to ensure that all deliveries are timeously received by our Customers, due to the influx in demand over the promotional period, customers may experience unforeseen delays in the receipt of the delivery of their order(s).

d. Unless expressly stated otherwise, promotional stock is limited, and the promotional items are only available subject to stock availability and/or when it reaches its stock limit for the promotion, thereafter the promotional goods will revert to its original price.

e. Adding a promotional item to your cart does not reserve the item, nor does it guarantee that you will receive the goods, as the goods are only reserved upon successful completion of checkout and the funds being received in our account. DEFECTIVE OR FAULTY PRODUCTS

We currently only offer two delivery options: Standard Delivery and Same Day Delivery

1. Standard Delivery Terms and Conditions:

1.a. Standard Delivery option with a standard delivery period of 2 to 5 working days and a delivery fee of R65.00. Deliveries are made Monday to Friday, between 10h30 and 17h00. Toys R Us/Babies R Us does not deliver over weekends and on any recognized/ statutory South African public holidays.

1.b. Delivery of any order by Toys R Us/Babies R Us will only be effected to accessible areas, in the sole discretion of Toys R Us/Babies R Us, situate within the borders of the Republic of South Africa and.

1.c. Our deliveries are subject to Regional and High Risk Areas which can result in delays, a surcharge or cancellation.

1.d. Should you wish to amend or change the delivery address of your order, kindly contact our Customer Service Team at (+27) 87 234 8697 or [email protected] in order to effect the change. Kindly note that the change of delivery address will only be applicable where the order has not been dispatched from our Online Store. Toys R Us/Babies R Us will not incur any liability in the successful delivery of the order to the nominated delivery address as per the order confirmation email.

1.e. Whilst we endeavour to make every effort to ensure that accurate shipping estimates are provided on the website, we make no warranty that the order will be received by you within said time.

1.f. Unfortunately, items may be delayed for a variety of reasons beyond our control. When we are informed of any delays that will mean your items will arrive after the shipping estimate period has elapsed, then we will attempt to notify you as soon as possible. You may cancel a delayed item, without incurring any re-stocking fees, at your discretion, or wait for it to arrive.

1.g. Due to the influx of purchases taking place on Black Friday and the festive period, and while we will always endeavour to ensure that your Order(s) are timeously delivered, kindly anticipate unforeseen delays due to the strain placed on our couriers nationally.

2.Same Day Delivery Terms and Conditions:

2.a.Same day delivery will be available to customers near selected Toys R Us / Babies R Us stores. Same Day delivery will ONLY be eligible on delivery orders placed before 4pm, excluding weekends and Public Holidays.

2.b.Unfortunately, we are unable to change any orders set for Collection or Standard Delivery to an order for Same Day delivery. The order will need to be cancelled and a new order will need to be placed for same day delivery.

2.c.This service is currently only available within a 15km radius of selected Toys R Us / Babies R Us stores, with the exclusion of Regional and High-Risk areas.

2.d. Whilst we do endeavour to have your order delivered timeously, delays may occur due to a variety of reasons beyond our control. If we are, for whatever reason, unable to deliver your order on the same day, a representative from our Customer Service Team will attempt reaching out to you via email and telecom with confirmation of this.

2.e. Product restrictions do apply – unfortunately this service will not be available for large items, Gift Cards and items available for Pre-Order.

2.f. Due to this being a third-party service, we do not guarantee delivery at a specific time nor specific service levels for same day deliveries.

2.g. It will remain the customers responsibility to be available at the scheduled time to receive the order. Kindly note that a reschedule fee may apply for any failed deliveries.

2.h. Due to the influx of purchases taking place during Black Friday and the festive period, Toys R Us and Babies R Us reserves the right to suspend this Same Day Delivery service.

2.i. Customer Responsibility for Accurate Information

*It is the customer’s responsibility to ensure that the correct delivery address and telephone number are provided at the time of placing the order.

*Incorrect or incomplete details may result in delivery delays or failed delivery attempts.

2.j.Delivery Attempt Policy

*Same Day Delivery includes one delivery attempt only.

*The customer must ensure that someone is available at the specified address to receive the order during the delivery window.

2.k. PIN Verification

*A unique PIN will be sent via SMS to the customer’s provided mobile number.

*The recipient must provide this PIN to the delivery driver to complete the handover of the order.

2.l. Failed Delivery & Re-Delivery

* If the delivery attempt fails (inter alia, due to incorrect address, no one available, or inability to provide the PIN), the customer may:

*Request a re-delivery at an additional cost, which will be communicated before scheduling.

*Collect the order free of charge from the nearest store location.

*Non-Refundable Delivery Fee

a. Once you receive an SMS and / or email stating that your Order is “Ready for Collection”, your Order will be kept at the designated Click & Collect collection point for a period of 10 (ten) working days from the date of issue of the “Ready for Collection” SMS and / or email.

b. Toys R Us/Babies R Us reserves the right, unless authorised otherwise by its Customer Service Team, to cancel any Order(s) not collected with a period of 10 (ten) working days from date of “Ready for Collection” SMS and / or email.

c. Should Toys R Us/Babies R Us elect to cancel the Order, the purchaser will be offered a Gift Card or Store Credit to the equivalent value of the purchase.

d. Should you require to pick up the Order at a later point, you will have to provide your store of collection or our Customer Service Team ([email protected]) with an email, with the subject line “Delayed Order Collection – (Customer's order number)” so that our stores can make the necessary arrangements for collection and not cancel the order after 10 (ten) working days.

e. Should Babies R Us elect to cancel the Order, the purchaser will be offered a Gift Card or Store Credit to the equivalent value of the purchase.

f. Should you require to pick up the Order at a later point, you will have to provide our Customer Service Team ([email protected]) with an email with the subject line “Delayed Order Collection – (Customer’s Unique Code)” so that our stores can make the necessary arrangements for collection and not cancel the order after 10 (ten) working days.

a. Gift Cards can be purchased and redeemed at any of our Toys R Us / Babies R Us stores and online.

Our customers’ offer is deemed to only be accepted when they receive an order confirmation from Toys R Us/Babies R Us. By submitting your order and payment card details you warrant that you are authorised to make payment with the selected payment card and that there are sufficient funds available to pay for the order.

1. WHY USE THE BABIES R US REGISTRY?

1.a. The Babies R Us Registry (“Registry”) is an innovative service to provide ease of convenience to the mum-to-be as they prepare for their new exciting adventure in motherhood.

1.b. The Registry offers mum-to-be the opportunity to create and share their Registry with friends and family, to aid them on their wonderful motherhood journey, and ease the costs of child-care and birth.

1.c. Access to Baby Bank, allowing your guests to contribute or group-buy a gift registry item by adding money to a Baby bank. The funds available in your Baby Bank can be used exclusively for online purchases. These funds cannot be exchanged for cash or utilized for in-store transactions.

1.d. Babies R Us would also like to be part of the family in supporting mums-to-be in this journey, not only by our friendly and expert sales assistants and wide selections of goods for your specific needs, but by also providing mums-to-be with a Completion Discount, up to the value of 5% (five percent) of the total value bought off your Registry, for use on our online store.

1.e. All purchases from our Registry includes a 90-day return and/or exchange policy to ensure that our mum’s-to-be are satisfied with their purchases. Please note that this will be in-line with the Babies R Us returns/exchange policy.

1.f. Furthermore, we provide free delivery on all purchases made from your Registry.

2. HOW DO I QUALIFY FOR THE COMPLETION DISCOUNT?

2.a. Items in the Registry will need to be purchased to qualify for the 5% (five percent) Completion Discount.

2.b. A minimum value fulfilled of R2500-00 (two thousand and five hundred Rand) is required.

2.c The Registry must then be “closed” in order to receive the Completion Discount and an email will be sent to the recipient prompting the closure of the Registry in order to receive the Completion Discount.

2.d. The Registry must remain unaltered for a period of 14 days from the date of closure. (no re-instating/activations)

2.e. The Completion discount can only be redeemed online.

2.f. Should a Customer fail to close their Registry, the Registry will be automatically closed after 21 (twenty-one) days from the date of the Baby Shower. You will not be eligible to receive 2 (two) Completion Discount Coupons within a period 8 (eight) months from the last date of redemption.

3. HOW WILL I RECEIVE MY COMPLETION DISCOUNT?

3.a. Once you have met the above criteria and closed your Registry, the Completion Discount will automatically be loaded to your profile in the form of Baby Bank Credits, after 14 days..

3.b. If you do not receive your Completion Discount by the 15th day of your Registry being closed, please reach out to our Customer Service Team for assistance.

3.c. You may not receive and/or use another Completion Discount on your profile for a period of 12 (twelve) months since your last redemption.

4. FREQUENTLY ASKED QUESTIONS (FAQ's)

4.a. Can I create a registry without creating an account on the Babies R Us website? Unfortunately, you will be unable to create a Registry without first creating an account on the website. The creation of your account on our website is integral as this will allow you to transact on our website and store your Registry for ease of access and sharing.

4.b. Do I need to have an account to purchase off a Registry as a guest? If you are purchasing the goods online, you will have to registered an account on the Babies R Us website. This will also be necessary to allow for items purchased online to be updated on the Registry to “purchased”. The purchasing guest will need to logon to their account, or create an account, when making a purchase off a Registry.

4.c. What is the return/exchange policy for an item purchased off the Registry? We have a 90-day returns policy from the date of purchase only for the items purchased from the Registry. The customer is required to be in possession of a gift receipt or invoice and the Registry ID must be indicated on the receipts.

4.d. Will you be able to purchase on a Registry after the Baby Shower date? Once the Registry is closed on the system, no further purchases will be allowed to be made from the Registry.

*The Customer hereby releases and discharges and agrees to hold Babies R Us, its representatives or assignees, and all persons acting under his/her permission or authority or those for whom he/she is acting, free from any liability by virtue of any reason in connection with the making and use of such Material, including blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur to be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication of them, including without limitation any Claim for libel or violation of any right or publicity or privacy.

* Notwithstanding the above release and indemnities, the Entrant and/or Minor(s) shall have the right to claim authorship in the work, and to object to any distortion, mutilation or other modification of the work where such action is or would be prejudicial to the honour or reputation of the Entrant and/or Minor(s) including but not limited to the use of the Material for illegal purposes.

* Toys R Us & Babies R Us South Africa YouTube Channels;

* Toys R Us & Babies R Us South Africa websites and blogs;

* Toys R Us & Babies R Us South Africa TikTok Accounts;

* Toys R Us & Babies R Us South Africa Pinterest Accounts;

* As well as print and voice media.

3.c. By entering into a Competition, the Entrant hereby agrees to the following:

* That the entrant has been duly informed of the rights accrued in terms of the POPI Act and specified the manner in which it will process the personal information and/or special personal information in terms of the POPI Act.

* In consideration for participation in the Competition, and/or as the parent/legal guardian of any Minor(s) included in any photographs and recordings for purposes of the Competition, and hereby grants the following rights and permissions to Babies R Us, its representatives, and assignees, those for whom the Babies R Us is acting, and those acting with its authority and permission, the absolute right and permission to:

- Use the Material in media (consumer print, out-of-door usage, POP, a collateral in-store, marketing and public relations materials, broadcast media, cable, radio, internet, social media platforms), internal use by Babies R Us, public relations, point of purchase, go-cards, packaging, all forms of print, collateral, corporate advertising, in-cinema and industrial use as well as for education documentary and informative purposes, for all types of internal or external non-commercial communications such as for instance but not only, the Babies R Us website terms and conditions, annual report and press pack under the terms and conditions of this Competition, and such usage shall not give rise to remuneration.

- Take, use, re-use, publish, and re-publish the material of the Entrant, family members and/or the Minor(s) in which they may be included in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations from time to time, in conjunction with the names of the respective parties, or reproductions of such Materials in colour or otherwise, made through any medium at a studio or elsewhere, and in any and all media now or hereafter known, including the internet, for art, advertising, trade, or any other purpose whatsoever. The Entrant consents to the use of any published matter in conjunction with such photographs.

* The Entrant acknowledges that in connection with the production or anticipated production of the Material that they hereby release and indemnify Babies R Us, its affiliates and subsidiaries and/or its respective agents, directors, officers, shareholders, employees, representatives and all persons acting on their behalf from any and all claims, demands, causes of action, costs, expenses or other liabilities that may arise from any and all injuries that the Entrant and/or any Minor(s) may sustain as a direct, indirect or consequential result of the use of the Material (hereinafter “Claims”).

* The Entrant hereby irrevocably consents to the unrestricted right to the processing and publication of Materials of the Entrant and/or Minor(s) in which the Entrant may be included, for editorial, trade, advertising, and any other purpose and in any manner and medium; and to alter and composite the same without restriction and without their respective inspection and/or approval. The Entrant hereby release Babies R Us and its representatives and assignees from all claim and liability relating to said Materials and the Entrant or any Minor(s) included for purposes specifically consent to the digital compositing or distortion of the portraits or pictures, including without any restriction any changes or alterations as to colour, size, shape, perspective, context, foreground or background. The Entrant waives any right that they or the Minor(s) may have to inspect or approve any finished product or products or the advertising copy or printed matter that may be used in connection with such Material or the use to which it may be applied.

* The Entrant hereby releases and discharges and agrees to hold Babies R Us, its representatives or assignees, and all persons acting under his/her permission or authority or those for whom he/she is acting, free from any liability by virtue of any reason in connection with the making and use of such Material, including blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur to be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication of them, including without limitation any Claim for libel or violation of any right or publicity or privacy.

* Notwithstanding the above release and indemnities, the Entrant and/or Minor(s) shall have the right to claim authorship in the work, and to object to any distortion, mutilation or other modification of the work where such action is or would be prejudicial to the honour or reputation of the Entrant and/or Minor(s) including but not limited to the use of the Material for illegal purposes.

* If any Minor(s) are included in whole or in part in the Materials, the Entrant hereby warrants that they are a legally competent adult and a parent or legally appointed guardian of the Minor(s), and that they have the necessary capacity to contract for the Minor(s) in the above regard. Furthermore, the Entrant warrants that they have read the above authorisation, release and these terms and conditions prior to its execution and that they are familiar with the contents and hereby consent to the release. This release shall further be binding on the Entrant and/or Minor(s) and their respective heirs, representatives and assignees.

3.d. Whilst every precaution is taken to ensure that personal information (and special personal information) in possession is kept secure, we cannot be held liable in the event that information is breached by an unauthorised third party where we could not have foreseen, and where we have not been reckless or grossly negligent in terms of our compliance with the Protection of Personal Information Act 4 of 2013. In the event of a breach, Babies R Us will take every necessary precaution to notify where applicable, the information regulator and the data subject pertaining to the breach and the measures taken to prevent any further loss of personal information and secure your account and/or information.

3.e. All Entrants may have their details removed from the Babies R Us database by submitting written request via email to [email protected]. Take note that if the details are removed, the entrant will forfeit their right to claim any prize and will no longer be regarded as being a part of the competition.

Please also note:

* Babies R Us reserves the right to amend, modify, change, suspend or cancel this competition and any prize/s, or any aspect linked thereof, without notice at any time, for any reason that it deems necessary. All Entrants will waive any rights that they may have in terms of this Competition and acknowledge that they will have no recourse against Babies R Us, its employees and agents.

* Participation in this Competition constitutes acceptance of these Competition rules, and all Entrants will agree to abide by these terms and conditions. Any derogation these Competition rules will not constitute a variation or amendment unless reduced to writing.

* Should there be any terms or conditions that you do not understand, it is your duty to contact TBabiesoys R Us ([email protected]) for further clarity regarding the terms and conditions.

* Babies R Us reserves full rights in respect of providing a prize to the winner with its decision being final and binding.

* Babies R Us reserve the right to vary, suspend, postpone or terminate this competition and any prizes, or any aspect thereof, for any reason whatsoever at any time without notice. In such event, all entrants agree to waive any rights that they have in respect of this competition and acknowledge that they will have no recourse against Babies R Us.

* In the event of a dispute in regard any aspect of the competition and/or these terms, the decision of Babies R Us will be final and binding and no correspondence may be entered into.

* By entering this competition, you agree to be bound by the terms set out above.
